CLOUD SERVICE TERMS

These terms apply to cloud hosting, backup, disaster recovery and related services supplied by Cloud Remedy.
These terms operate together with our Terms of Trade.
1. Scope of Services
Services may include cloud hosting, virtual servers, backup services, disaster recovery and managed infrastructure.
2. Service Availability
Services rely on third-party infrastructure including telecommunications networks, data centres and power supply.
Continuous or fault-free service cannot be guaranteed.
3. Customer Responsibilities
Customers are responsible for:
• maintaining backups of their data
• maintaining secure passwords
• maintaining internet connectivity
• maintaining appropriate cybersecurity protections.
4. Data Hosting and Customer Data
Where the Supplier hosts data:
• the Customer remains the owner of the data
• the Customer is responsible for ensuring the data complies with applicable laws
• the Customer must ensure they have authority to store any personal information.
5. Customer Content Responsibility
The Customer is solely responsible for the legality and ownership of content stored using the services.
If the Supplier becomes aware of unlawful content, the Supplier may remove or restrict access to such content.
6. Cybersecurity
The Customer is responsible for maintaining appropriate security measures within their systems.
The Supplier is not liable for losses caused by hacking, malware, ransomware or other cyber incidents.
7. Service Suspension
Services may be suspended where:
• invoices remain unpaid
• services are misused
• suspension is necessary to protect system security.
8. Supplier Dependencies
Services may rely on third-party providers including infrastructure providers, software vendors and telecommunications carriers.
The Supplier is not liable for failures caused by such providers.
9. Data Loss
No data storage system is completely secure.
The Supplier is not liable for data loss or consequential damages.
10. Limitation of Liability
Liability relating to cloud services is limited to the fees paid by the Customer in the six months preceding the event giving rise to the claim.
11. Termination
Services may be terminated according to agreed service terms.
Early termination fees may apply where services are cancelled before the end of a minimum service term.
12. Changes to Services
Services may be updated or modified where reasonably necessary to maintain performance, security or compatibility.
13. Governing Terms
These Cloud Service Terms operate together with the Supplier’s Terms of Trade and Privacy Policy.
