5. Credit Information and Credit Reporting

- payment history;
- overdue account information;
- default information;
- court or insolvency information; and
- commercial credit reports.
We may obtain commercial credit information from a credit-reporting body, trade insurer, another credit provider or a nominated trade reference.
Where permitted by the Privacy Act 1988 (Cth), we may disclose information concerning a serious overdue payment or default to a credit-reporting body after the applicable legal notices and waiting periods have been completed.
A credit-reporting body may include the disclosed information in a credit report and provide it to credit providers to assist them in assessing creditworthiness.
Default information may adversely affect a person’s or business’s ability to obtain credit.
Where a credit application involves a sole trader, partner, director or guarantor, we may collect and use relevant personal and credit-related information with the individual’s consent and as permitted by law.
6. Customer Data Hosted or Managed by Us
When we host, back up, transmit, maintain or support Customer systems, we may have access to data controlled by the Customer.
In those circumstances:
- the Customer remains responsible for determining the purpose for which the data is collected and used;
- the Customer remains responsible for the legality, accuracy and ownership of the data;
- the Customer must ensure that it has authority to provide the data to us;
- we will access and process the data only as reasonably necessary to provide, secure and support the Services, or as required by law; and
- our access to Customer data does not transfer ownership of that data to us.
7. Customer Content Responsibility
Customers are responsible for ensuring that content stored, transmitted or processed using our Services complies with applicable laws and does not infringe another person’s rights.
We may remove, restrict or suspend access to content where we reasonably believe that it is unlawful, malicious, infringing, harmful or creates a security or operational risk.
8. Overseas Disclosure and Processing
Some of our service providers, cloud platforms, software vendors and infrastructure providers may store or process information outside Australia.
The countries involved will depend on the products and Services used and may change from time to time.
Where overseas processing occurs, we take reasonable steps appropriate to the circumstances to ensure that personal information is handled consistently with applicable Australian privacy obligations.
However, overseas recipients may also be subject to the laws of their own countries.
